General Terms and Conditions (GTC) of YouMeUnity
for events and psychological counseling

§1 Scope of application
1.1 These General Terms and Conditions apply to all contracts for participation in retreats, seminars, trainings and workshops (online and offline, hereinafter referred to as “events”) as well as for psychological individual and couple sessions (hereinafter referred to as “counseling sessions”) concluded between YouMeUnity and the participant (hereinafter referred to as “customer”).
1.2 The version of the YouMeUnity TCs valid at the time of booking shall apply. The current version of these can be accessed by the customer at any time on the YouMeUnity website under GTC.
1.3 Deviating agreements must be made in writing and require the express consent of YouMeUnity.
§2 Subject matter of the contract
2.1 YouMeUnity offers events and psychological counseling sessions (individual, couple and group sessions). The services are provided both online and in person.
2.2 The content of the events and consultation sessions are explained in detail in the respective service descriptions on the YouMeUnity website.
§3 Conclusion of contract, registration and implementation of events/counseling sessions
3.1 The YouMeUnity website is available in German and English.
3.2 Registration for events and counseling sessions is made exclusively in writing by e-mail to info@youmeunity.com. Within 1 week of receipt of the registration e-mail, the customer will receive a confirmation of participation and the YouMeUnity account details for the advance bank transfer if YouMeUnity has all the data required for registration and subject to available capacity.
3.3 For new customers, YouMeUnity offers an initial couseling call of a maximum of 15 minutes free of charge. The telephone provider costs, if incurred by the telephone provider, shall be borne by the customer. If the Customer requires a longer consultation, they can book an individual session for a fee, subject to availability (see § 3.2).
3.4 A contract is only concluded after written confirmation by YouMeUnity and full receipt of payment from the customer. This secures the participant’s reservation. In the event that an event is already fully booked, YouMeUnity will inform the customer of this, keep their registration on a waiting list after confirmation by the customer and offer them participation if a corresponding participant place becomes available.
3.5 In the case of counseling services, the time of the consultation is agreed individually. Unless otherwise agreed, the place of consultation is YouMeUnity’s Praxisraum, Hauptstr. 119, 69117 Heidelberg, Germany.
3.6 Unless otherwise stated, the venue for all live group events is the YouMeUnity Erfahrungs- und Erlebnisraum, Hauptstr. 119, 69117 Heidelberg, Germany.
3.7 YouMeUnity’s offers are aimed exclusively at people over 18 years of age.
3.8 Arrival and departure shall be at the expense and risk of the customer.
3.9 YouMeUnity reserves the right to cancel events due to unforeseen circumstances (e.g. illness of the seminar leader). Unless otherwise stated, all events are conducted by Joy S. / Sandra Hochgesang and/or Thomas Hochgesang.
3.10 YouMeUnity assumes no liability for force majeure or other circumstances beyond YouMeUnity’s control that lead to the cancellation of an event / counseling session.
3.11 YouMeUnity uses the digital communication platform Zoom for online events and sessions. The customer is responsible for ensuring a stable internet connection. Should the customer experience connection problems during the session, YouMeUnity may postpone the session at its discretion. In any case, if technical impairments occur on the part of the customer, the customer is obliged to full payment of the agreed service, even if the session cannot be terminated for technical reasons. In the event of technical impairments on the part of YouMeUnity, the customer will be refunded the participation fees paid or can arrange an appointment for a replacement online event/session with YouMeUnity. Further claims are excluded.
§4 Conditions of participation
4.1 Participation in a YouMeUnity event or counseling session is voluntary. The customer bears full responsibility for their actions before, during and after the respective event/counseling session. The customer is responsible for any damage caused by the customer and indemnifies YouMeUnity, its assistants, guest lecturers and, if applicable, external seminar houses from all liability claims.
4.2 YouMeUnity is only liable in accordance with the statutory provisions for damages caused by intent or gross negligence.
4.3 YouMeUnity, assistants and guest lecturers of YouMeUnity are authorized to give instructions to the participants during the entire event/counseling session.
4.4 Psychiatric illnesses and contagious infectious diseases preclude participation in an event/counseling session.
4.5 YouMeUnity events and counseling sessions are not psychotherapeutic or psychiatric measures. YouMeUnity points out that counseling is not a substitute for medical treatment. The customer is responsible for seeking further professional help. YouMeUnity events and counseling sessions require normal mental and physical resilience. If this does not apply to the customer, if he/she is in a compromised state of health or is under medication, he/she undertakes to inform YouMeUnity of this before the start of the event/counseling session.
4.6 YouMeUnity reserves the right to exclude customers from events/counseling sessions if they have recognizable health or mental impairments and a danger to themselves and others cannot be ruled out.
4.7 If a customer repeatedly and persistently disrupts an event/counseling session despite a warning or behaves in a manner that is significantly contrary to common decency, so that the smooth running of the event/counseling session is no longer guaranteed, YouMeUnity reserves the right to expel this customer from the group or the premises. In this case, any claims for reimbursement on the part of the customer are null and void.
§5 Terms of payment
5.1 The participation fee for events and consultation sessions must be paid in advance.
5.2 The amount of the participation fee is based on the prices published on the YouMeUnity website at the time of registration. In principle, the regular price must be paid for each event. Wealthy persons may pay the respective sponsorship fee at their own discretion. Students, pensioners and low-income earners who wish to take advantage of a reduced price must indicate this when registering and can assert this claim after confirmation by YouMeUnity.
5.3 Unless otherwise agreed by YouMeUnity, the participation fee for all group events is due no later than 14 days after receipt of the registration confirmation. If the amount is not transferred in full and on time within this period, YouMeUnity reserves the right to cancel the participant’s reservation.
5.4 Counseling services are invoiced according to the price scale specified on the “Individual sessions” subpage.
5.5 A payment is only deemed to have been made when YouMeUnity can view the amount in its own account and dispose of it unconditionally.
5.6 Arrival and departure costs, accommodation and meals are not included in the respective offer price. Travel is at the customer’s own expense. For events outside of YouMeUnity, the customer books accommodation and meals at their own expense with the respective seminar house. The customer is responsible for complying with the respective payment and cancellation conditions of the seminar house. If the customer books transportation or accommodation to attend a YouMeUnity event, YouMeUnity recommends taking out travel cancellation insurance. If the event takes place at YouMeUnity, the customer can book an overnight stay at YouMeUnity, subject to availability. The prices for this can be found on the respective offer website. For events lasting several days in YouMeUnity’s Erfahrungs- und Erlebnisraum, the organizer charges a flat rate of EUR 10 per day per person for muesli breakfast, snacks, fruit, raw vegetables, coffee, tea and chocolate, which is to be paid in cash by the customer on site.
5.7 The customer may only take advantage of special prices if YouMeUnity has confirmed the availability of the corresponding special price in the registration and the customer has met the deadlines for registration and payment applicable to the special price. If the customer pays late or does not pay at all, he/she loses the right to participate. If the special price is a price subject to a deadline connect to a special date, for example an early booking discount, the customer must pay the full event price if payment is received after the deadline.
§6 Withdrawal and cancellation
6.1 Cancellation of participation in events is possible up to 30 days before the start of the event less a processing fee of 20 %.
6.2 If the cancellation is made up to 10 days before the start of the event, a cancellation fee of 50% of the participation fee will be charged.
6.3 In the event of cancellation less than 10 days before the start of the event, no-show or termination of the event, the full event fee shall be payable.
6.4 Cancellation of counseling services is possible free of charge up to 3 days before the counseling appointment. Cancellations between 48 and 25 hours before the appointment will incur a 50% cancellation fee. In the event of later cancellation or no-show, the full fee will be charged.
6.5 In the event of cancellation by YouMeUnity, the customer will be refunded all participation fees paid. Further claims are excluded.
6.6 Once the full participation fee has been paid, a one-off rebooking is possible by prior arrangement for a rebooking fee of 20% of the participation fee.
6.7 Up to 3 days before the start of the event, the customer can transfer their registration to another person of the same gender by email for a processing fee of 10% of the event costs. In order for YouMeUnity to accept this person as a replacement, a written declaration of consent from this person is required, as well as the provision of all registration data requested by YouMeUnity.
§7 Cancellation policy for consumers
7.1 The customer is entitled to revoke this contract in writing within 14 days of receipt of the registration confirmation without giving reasons.
7.2 The revocation, including the repayment of all payments made within 14 days of receipt of the revocation by the customer, is free of charge for the customer.
7.3 The customer can access further information on revocation, including a sample revocation form, at any time on the subpage of the YouMeUnity website under the “Revocation” tab.
§8 Confidentiality and data protection
8.1 All personal data collected in the course of events and counseling sessions for customer registration and all information exchanged is subject to confidentiality and will not be passed on to third parties.
8.2. YouMeUnity verpflichtet sich, die Bestimmungen des Datenschutzes gemäß den einschlägigen gesetzlichen Vorschriften zum Datenschutz wie der Datenschutz-Grundverordnung (DSGVO) der Europäischen Union und auch dem Bundesdatenschutzgesetz (BDSG) einzuhalten.

§9 Reference to the consumer arbitration procedure
YouMeUnity points out that it is not willing or obliged to engage in dispute resolution proceedings before a consumer arbitration board under the Consumer Arbitration Act.
§10 Reference to the possibility of online dispute resolution

§11 Final provisions
11.1 This contract and its implementation shall be governed exclusively by the law of the Federal Republic of Germany.
11.2 The contractual language is German.
11.3 Should individual provisions of these GTC be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the remaining provisions shall remain unaffected.
11.4 The place of jurisdiction is the registered office of YouMeUnity.
