General Terms and Conditions (GTC) of YouMeUnity

for Events and Psychological Counselling

This English version is provided for convenience. The contractual language is German.

§1 Scope

1.1 These General Terms and Conditions apply to all contracts relating to participation in retreats, seminars, training programmes and workshops (online and offline, hereinafter referred to as “Events”) as well as individual and couples psychological counselling sessions (hereinafter referred to as “Counselling Sessions”) entered into with YouMeUnity. The person making the booking is referred to as the “Customer”; the persons taking part in the respective Event or Counselling Session are referred to as “Participants”. The Customer and the Participant may be the same person.

1.2 The version of the YouMeUnity GTC valid at the time of booking shall apply. The current version is available to the Customer at any time on the YouMeUnity website under GTC.

1.3 Any agreements deviating from these GTC must be made in writing and require the express consent of YouMeUnity.

§2 Subject Matter of the Contract

2.1 YouMeUnity offers Events and psychological Counselling Sessions (individual, couples and group sessions). Services are provided both online and in person.

2.2 The content of Events and Counselling Sessions is described in detail in the respective service descriptions on the YouMeUnity website.

§3 Conclusion of Contract, Registration and Delivery of Events/Counselling Sessions

3.1 The YouMeUnity website is available in German and English.

3.2 Registration for Events and Counselling Sessions takes place via the booking options provided on the YouMeUnity website or via external booking platforms used by YouMeUnity for this purpose. In individual cases, registration may also be made by e-mail following prior agreement.

3.3 New Customers may have an initial consultation of up to 15 minutes free of charge with YouMeUnity. Any telephone charges incurred by the Customer’s telephone provider shall be borne by the Customer. If the Customer requires further counselling, they may, subject to availability, book a paid individual session (see § 3.2).

3.4 Where an Event initially requires a booking request or waiting list registration, this does not constitute a binding booking. Following review of the request and subject to available capacity, the Customer will be given the opportunity to make a binding booking. There is no entitlement to acceptance of a booking request or allocation of a place at an Event.

3.5 If a Customer books an Event for one or more additional persons at the same time, they are obliged to provide those persons with the GTC applicable to the booking as well as the YouMeUnity Participation Agreement for their review and to ensure, prior to participation, that the additional Participants agree to the provisions applicable to their participation. All Participant details required for the additional persons must be provided fully and truthfully during the booking process.

3.6 The contract is concluded upon confirmation of the booking by YouMeUnity or via the booking platform being used, unless otherwise stated in the specific booking process. Payment shall be made using the payment methods offered in the respective booking process. For Events involving a prior booking request or waiting list, the contract is only concluded upon completion of the subsequent binding booking.

3.7 For Counselling Sessions, the appointment time is agreed individually. Unless otherwise agreed, Counselling Sessions generally take place at the YouMeUnity practice premises, Hauptstr. 119, 69117 Heidelberg, Germany.

3.8 Unless otherwise stated, the venue for all in-person group Events is the YouMeUnity Erlebnis- und Erfahrungsraum, Hauptstr. 119, 69117 Heidelberg, Germany.

3.9 Events are generally conducted in German. For international groups, English or another language may also be used.

3.10 YouMeUnity’s services are exclusively available to persons aged 18 or over.

3.11 Customers are responsible for the costs and risks associated with their own travel to and from the Event.

3.12 YouMeUnity reserves the right to cancel Events due to unforeseen circumstances (e.g. illness of the Event facilitator). Unless otherwise stated, all Events are facilitated by Joy S. / Sandra Hochgesang and/or Thomas Hochgesang.

3.13 YouMeUnity accepts no liability for force majeure or other circumstances beyond YouMeUnity’s control that result in the cancellation of an Event or Counselling Session.

3.14 YouMeUnity uses the digital communication platform Zoom for online Events and Sessions. The Customer is responsible for ensuring a stable internet connection. Should connection problems occur on the Customer’s side during the Session, YouMeUnity may, at its discretion, reschedule the Session. Where technical difficulties occur on the Customer’s side, YouMeUnity shall in any case remain entitled to full payment of the agreed fee, even if the Session cannot be completed for technical reasons. If technical difficulties occur on YouMeUnity’s side, the Customer shall receive a refund of the participation fees paid or may arrange an alternative online Event/Session with YouMeUnity. Further claims are excluded.

§4 Conditions of Participation, Personal Responsibility and Safety

4.1 Participation in YouMeUnity Events and Counselling Sessions is voluntary. Participants are responsible for their own decisions and behaviour as well as for recognising and communicating their personal boundaries.

4.2 Participation is additionally subject to the provisions of the YouMeUnity Participation Agreement incorporated into the respective booking process, particularly with regard to personal responsibility, health and psychological stability, personal boundaries and consent, mindful interaction, alcohol, drugs and medication, confidentiality, safety and liability.

4.3 YouMeUnity’s services are not a substitute for medical treatment or psychotherapy. Participation requires Participants to be sufficiently physically and psychologically able to take part. Any circumstances that may affect safe participation must be communicated to YouMeUnity in good time and to the extent necessary. Further requirements are set out in the Participation Agreement.

4.4 YouMeUnity, the Event facilitators, assistants and persons commissioned by YouMeUnity are authorised to give instructions during an Event or Counselling Session insofar as this is necessary for the safe running of the Event or Session, the protection of Participants or the protection of the venue.

4.5 YouMeUnity may exclude Participants wholly or partly from an Event or Counselling Session if safe participation does not appear to be ensured or if their behaviour jeopardises the safety, boundaries, integrity or process of other Participants, the team or the space. The consequences of exclusion, particularly with regard to any potential refund, are governed by the Participation Agreement.

4.6 The liability of YouMeUnity, the Event facilitators, assistants and persons commissioned by YouMeUnity is governed by the applicable statutory provisions and the supplementary provisions of the Participation Agreement.

§5 Payment Terms

5.1 Participation fees for Events and Counselling Sessions must generally be paid in full before they begin. The payment methods currently available are displayed during the booking process.

5.2 The amount of the participation fee is determined by the prices stated for the respective offer at the time of booking. Where an Event is offered under a solidarity-based pricing model, the Customer independently selects from the available price levels the contribution that corresponds to their current financial circumstances. No proof of financial circumstances is required. YouMeUnity trusts Customers to use the solidarity-based pricing model mindfully and fairly.

5.3 The participation fee for group Events is due within the payment period specified during the booking process or in the booking confirmation. If the amount is not paid in full and on time, YouMeUnity reserves the right to release the Participant’s place.

5.4 Counselling services are charged in accordance with the pricing structure stated on the Individual Sessions page.

5.5 Payment is deemed to have been made once it has been successfully completed via the selected payment method or credited to YouMeUnity.

5.6 Travel to and from the Event, accommodation and meals are not included in the respective offer price. Customers are responsible for their own travel costs. For Events taking place outside YouMeUnity’s premises, the Customer books and pays for accommodation and meals directly with the respective retreat venue. The Customer is responsible for observing the venue’s respective payment and cancellation terms. If the Customer books transport or accommodation in order to attend a YouMeUnity Event, YouMeUnity recommends taking out travel cancellation insurance. For travel abroad, we additionally recommend taking out international travel health insurance. If an Event takes place at YouMeUnity, the Customer may, subject to availability, book overnight accommodation with YouMeUnity. Prices can be found on the respective Event webpage. For multi-day Events held at the YouMeUnity Erlebnis- und Erfahrungsraum, the organiser charges an expense contribution of EUR 10 per person per day for a muesli breakfast, snacks, fruit, raw vegetables, coffee, tea and chocolate, payable by the Customer in cash on site.

5.7 In addition to the price levels offered under the solidarity-based pricing model, YouMeUnity may offer special prices for individual Events that are limited in time or quantity, such as early-bird prices. These may only be claimed within the stated booking and payment deadlines or for as long as the respective allocation remains available. The conditions stated in the respective offer or booking process shall apply.

§6 Withdrawal and Cancellation

6.1 Participation in Events may be cancelled up to 30 days before the Event begins, subject to a processing fee of 20%.

6.2 If cancellation takes place up to 10 days before the start of the Event, a cancellation fee of 50% of the participation fee will be charged.

6.3 If cancellation takes place fewer than 10 days before the start of the Event, or in the event of non-attendance or withdrawal after the Event has begun, the full Event fee is payable.

6.4 Counselling services may be cancelled free of charge up to 3 days before the scheduled appointment. For cancellations made between 48 and 25 hours before the appointment, a cancellation fee of 50% is payable. For later cancellations or non-attendance, the full fee is payable.

6.5 If YouMeUnity cancels an Event, the Customer will receive a refund of all participation fees paid. Further claims are excluded.

6.6 Once the full participation fee has been paid, a booking may be transferred once to another Event following prior agreement and subject to a rebooking fee of 20% of the participation fee.

6.7 Up to 3 days before the start of an Event, the Customer may, following prior agreement with YouMeUnity and subject to a processing fee of 10% of the Event fee, transfer their booking to another person of the same gender. Such a transfer requires YouMeUnity’s consent as well as full provision of all registration details required for the replacement Participant. Before the Event begins, the replacement Participant must review and accept the GTC and Participation Agreement applicable to their participation.

§7 Special Provisions for Retreats Abroad

7.1 The contract between the Customer and YouMeUnity is governed exclusively by German law, including where Events take place abroad.

7.2 The respective retreat venue or external service provider is solely the contractual partner for accommodation, meals, travel, transfers or excursions.

7.3 Extended cancellation periods apply to retreats abroad: cancellation at a reduced cost is only possible up to 60 days before the Event begins; until this point, a processing fee of 20% will be charged. From 59 days before the start of the Event, the full participation fee is payable.

7.4 For retreats abroad, we recommend taking out travel cancellation insurance as well as international travel health insurance.

§8 Right of Withdrawal for Consumers

8.1 Where provided for by law, consumers entering into distance contracts have a right of withdrawal for a period of 14 days. The withdrawal period generally begins upon conclusion of the contract. To exercise the right of withdrawal, a clear statement to YouMeUnity is sufficient; no reason needs to be given.

8.2 Withdrawal, including the refund of all payments made within 14 days of YouMeUnity receiving the Customer’s notice of withdrawal, is free of charge for the Customer.

8.3 Further information about the right of withdrawal, including a model withdrawal form, is available at any time under Withdrawal on the YouMeUnity website.

§9 Confidentiality and Data Protection

9.1 All personal data collected for the purpose of Customer registration in connection with Events and Counselling Sessions, as well as all information exchanged, is treated confidentially and will not be disclosed to third parties.

9.2 YouMeUnity undertakes to comply with the applicable statutory data protection provisions, including the European Union’s General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

9.3 The Privacy Policy available on this website shall additionally apply.

§10 Information on Consumer Dispute Resolution

YouMeUnity hereby states that it is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body under the German Consumer Dispute Resolution Act (VSBG).

§11 Final Provisions

11.1 This contract and its performance are governed exclusively by the laws of the Federal Republic of Germany.

11.2 The contractual language is German.

11.3 Should individual provisions of these GTC be or become invalid or unenforceable, either at the time the contract is concluded or subsequently, the validity of the remaining provisions shall remain unaffected.

11.4 To the extent permitted by law, the place of jurisdiction shall be YouMeUnity’s registered place of business. In all other respects, the statutory provisions governing jurisdiction shall apply.
